Describe the ‘impeachment’ procedure.

Answer

  • (1)The Constitution lays down the impeachment’ procedure for the removal of the President of India.
  • (2)The President can be impeached by Parliament for violation of the Constitution or an act of treason.
  • (3) The impeachment motion can be moved in either House and passed by two-thirds majority whereby the charges against the President are finalised.
  • (4)The other House conducts the inquiry of the charges. The President or his attorney is given the opportunity to refute the charges.
  • (5) At the end if the House finds the President guilty of charges, passes the impeachment motion by two-thirds majority.
  • (6) Thereafter the President is removed from his office.
